Personal Information

I take the confidentiality of my clients, your privacy and safety of your personal information very seriously and endeavour to keep your information as safe as possible. I will only use the information you provide me with for the intended purpose. I adhere to current data protection legislation, including the General Data Protection Regulation (EU/2016/679) (the GDPR) and the Data Protection Act 2018.

The type of personal information I collect

I currently collect and process the following information:

·       Personal identifiers, contacts and characteristics (for example, name, phone number, email address) as part of the initial contact or enquiry.

·       Further detailed information about you is collected as part of the assessment if we decide to work together (for example your GP contact details, your emergency contact, your medical history relevant to therapy, etc)

 

How I get the personal information and why I have it

Most of the personal information I process is provided directly and voluntarily by you for one of the following reasons:

·       You have contacted me to enquire about therapy via my website, email, phone or  a platform that we use for our practice management.

·       We are working together and  you have provided your details and information in order to commence therapy.

I use the information that you have given me to enable me to provide you with the most suitable therapy tailored to  your needs and to provide you with the best possible support.

All your details are confidential and will not be shared with anyone else (please see Limits to Confidentiality below) I  will never share your data with any external third party for a commercial purpose. If  I have to share your information I will discuss this with you first, unless there is a safeguarding issue or I am required to share the information by law.

Limits to confidentiality:

·       Legal obligation

I will have to break confidentiality if I am required to do so by court of law order. I will also be required to break confidentially should any client disclose any potential acts of terrorism, money laundering, fraud or crime.

·       Safeguarding concerns

I may have to break confidentiality if there is a legitimate risk of harm to self, others or in case there are concerns over a safeguarding of a child/children or vulnerable adults.

·       Supervision

I am required to have a clinical supervision on my client work in order to comply with the BACP Code of Ethics. I discuss my client work with my supervisor, however, no identifiable personal data is shared with my supervisor and my clients are referred to by first name or by their initials only.

·       At your request

In instances where you have requested I share the information about you and you give explicit consent, in writing, for the confidence to be broken.

 

How I store your personal information

Your information is securely stored.

I store all the electronic data on a password protected computer or password protected mobile phone.

Any paper records containing personal data are kept to an absolute minimum and are stored in the locked filing cabinet.

I keep the assessment form and sessions notes open while you are in therapy. When we conclude therapy, I will keep the documents for 5 years, after this time period your personal information will be deleted (electronic) and destroyed (hard copies), anonymised session process notes may be retained indefinitely.

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask for copies of your personal information.

Your right to rectification - You have the right to ask me to rectify personal information you think is inaccurate. You also have the right to ask me to complete information you think is  incomplete.

Your right to erasure - You have the right to ask me o erase your personal information in certain circumstances.

Your right to restriction of processing - You have the right to ask me to restrict the processing of your personal information in certain circumstances.

Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that I transfer the personal information you gave me to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, I have one month to respond to you.

 

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

·       Your consent. You are able to remove your consent at any time. You can do this by contacting Martina Kirkland Counselling

·       I have a contractual obligation.

·       I have a legal obligation.

·       I have a vital interest.
